This agreement regulates the general conditions of purchase of the various products and services offered on this website, www.miluka.es, a domain operated by IDKEN GROUP, S.L. (hereinafter MILUKA) with Tax ID No. B42693986 and registered office at C/Luis Batlles, nº 59 bajo 21 (03650) Pinoso, Alicante (Spain).
At the time of completing the registration process and purchasing any of our products, the CUSTOMER expressly accepts and submits to the clauses specified below, as well as to the conditions of access and use of our portal and its privacy policy, accessible through the “Legal Notices” link.

1. PRICES AND TAXES
In consideration for the purchased product, the CUSTOMER expressly agrees to pay MILUKA the amounts specified at the time of purchase in the price list established on the website www.miluka.es for the selected products.
The products offered on this website are subject to Value Added Tax (VAT), which IS INCLUDED in the prices listed for each product.
The delivery of the items will be deemed to be located within the VAT-application territory if the delivery address is located within Spanish territory, excluding the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the legally applicable rate at any given time, depending on the specific item in question. For orders destined for the Canary Islands, Ceuta, and Melilla, deliveries will be exempt from VAT, without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of these territories.
For shipments to countries within the European Union, Spanish VAT will be deducted, and the corresponding VAT rate will be applied to the destination country based on the annual turnover in that country.
Shipping costs are NOT included in the price of the products.
Once the product selection is complete, prior to confirming the order and proceeding to payment, the final purchase price will appear on the screen, including VAT (Value Added Tax), handling, packaging, and shipping costs, if applicable, which will be reflected in the order form at the time of purchase and on the invoice.
Anything not specified in the description as included is not included.
Coupons issued by MILUKA for purchases through www.miluka.es are for single use only, and all customers are authorized to make only one purchase per user.
2. PURCHASE PROCEDURE
Only individuals over 14 years of age and companies may place orders through this website.
All our products are detailed individually on the website. The procedure for making and managing purchases is indicated on the website, and you only need to follow these steps:
a. Choose the product you wish to purchase.
b. When you select a product, it will be added to your Shopping Cart, and you can choose to continue shopping or process the order.
c. To process your order, if this is your first time accessing our portal, you must complete a registration form with your personal information and create a personal user account. Once this step is completed, you will receive confirmation of successful registration via the email address you provided. If you are already a registered user, to continue with the purchase process, simply enter the username and password you created during your initial purchase. The username and password are personal and belong to the person who completed the registration process, who is solely responsible for their safekeeping. Through your account, you can manage the information we have and modify or update your information.
d. Your order will then be verified, detailing the selected items one by one, and calculating the total price.
e. Likewise, you will be required to provide the billing and delivery addresses for your purchase. You may provide a single address for both billing and delivery.

Occasionally, we offer special coupons to our customers. However, please note that these coupons are not applicable to lamps, rugs, and promotional products (discounts, clearance sales, two-for-one, etc.), nor are they applicable to professional customers.
3. AVAILABILITY AND DELIVERY
The products offered by MILUKA are available for distribution throughout the European Union.
At MILUKA, delivery times are generally between 24 and 72 business hours (although some products have a longer delivery time indicated in the product details). Orders placed after 12:00 p.m. will be processed the next day. Orders placed on Saturdays, Sundays, or public holidays will also be processed the next business day.
A single order may contain multiple items with different delivery dates; in this case, the order will be shipped based on the longest delivery time.
Products offered by MILUKA are always subject to availability, which will be specifically indicated on our website for each product, showing the delivery time for each. Therefore, if an item offered is unavailable, the customer will be duly informed of this unavailability for purchase. Under normal conditions, all products listed on our website are available for delivery within the indicated timeframes.
In cases where, after the order has been placed, the product purchased by the CUSTOMER is out of stock, the CUSTOMER will be duly informed and offered an alternative product with similar characteristics and equal price and quality to the one purchased. If, despite this, the CUSTOMER is not interested in accepting the proposed alternative, MILUKA will refund the amount already paid and inform the CUSTOMER of the refund procedures and deadlines.
As a general rule, the maximum delivery time for the product to the customer’s home or for collection from our warehouse at Camino del Prado 36-A, 03650 Pinoso, Alicante, from the moment of purchase until we have confirmed your payment, is indicated in the description of each product, and the CUSTOMER may verify this information before making the purchase.
These delivery times are approximate and in no way binding on MILUKA.
Deliveries will be made on business days (Monday to Friday). It is recommended that the CUSTOMER communicate their preferred delivery time when completing the order details in the Comments section.
If you have opted for home delivery of the purchased product, this will be carried out by the carrier along with a delivery note to the address indicated on the order form, which the customer must sign as proof of receipt. Likewise, the CUSTOMER will be duly informed in the event of an incident or delay in delivery for any reason.
If delivery to the indicated address is not possible due to the recipient’s absence, MILUKA reserves the right to make a second delivery. If delivery cannot be made for any reason, MILUKA will coordinate communication between the CUSTOMER and the carrier. The carrier will contact the CUSTOMER directly and provide detailed instructions on the steps to follow. In the event that delivery is not possible due to an incorrect address, the cost of reshipping the order will be borne by the CUSTOMER. MILUKA is not responsible for delays in the delivery of purchased items due to causes attributable to the carrier.
If the use of a lifting platform is necessary to transport the merchandise to the address, the customer must inform us in advance in the comments section of the purchasing process when placing the order. The costs associated with this service will always be borne by the CUSTOMER.
To ensure you are informed at all times about the progress of your purchase, you will receive an email confirming your order and, where applicable, payment.
Likewise, the CUSTOMER can check the status of their order on the shipping company’s website. To do so, the CUSTOMER must contact us, and we will provide the link and access code to view the order status. In any case, MILUKA will send the CUSTOMER an email when their order is on its way.
4. PAYMENT AND PAYMENT PERIODS
The following payment methods are accepted:
– Credit and Debit Card: The transaction is made by connecting directly to the bank La Caixa through its payment gateway.
– PayPal: Connecting directly to PayPal.
– Bank transfer: When placing the order, select payment by transfer and confirm the order, the bank details will appear so you can make the payment into our account. We will also send an email to the account you registered with, providing information about your order and payment details. – Cash on delivery: The exact amount must be paid to the carrier making the delivery. Once payment has been made, you will receive a confirmation email. If the CUSTOMER wishes to obtain an invoice, they simply need to access “My Account” with their login details, where they can download the invoice directly to their order list. All our products are subject to quality controls and are guaranteed against manufacturing defects for a period of 3 years from the date of delivery. The warranty covers any manufacturing, design, or material defects, although the lack of conformity must be reported within 2 months of becoming aware of it. The warranty only covers defective products; it does not cover impacts, improper use, tampering, incorrect installation, or materials subject to wear and tear from normal use, or any other damage not attributable to a supplier defect or a defect in the product. During the warranty period, the CUSTOMER may return the product, and we will repair or replace it. These costs will be free of charge for the user, including the costs of correcting the non-conformity of the products and shipping costs, as well as costs related to labor and materials. The CUSTOMER has the right to withdraw from this contract within 14 calendar days without providing any reason. Consequences of withdrawal: Once you have notified us of your withdrawal request, you must return the goods to MILUKA or deliver them directly to us without undue delay and, in any case, no later than 14 calendar days from the date you notify us of your decision to withdraw from the contract. This deadline will be deemed met if you return the goods before the expiration of this deadline. In any case, the return will always be subject to prior examination by MILUKA of the condition of the returned product and verification that the requirements set forth in these terms of sale have been met. Once the return is received and if applicable, we will refund the amount charged within a maximum period of 30 days and under the same terms used to make the payment. The product must be returned in the same condition in which it was delivered, preserving its original packaging. MILUKA reserves the right to reject returns communicated or sent outside the established period or products that are not in the same condition as when received. In the event of incorrect shipments by MILUKA, MILUKA will reship the correct order and will be responsible for the shipping costs and collection costs for the incorrect merchandise. Returns or exchanges of products will only be accepted in the event of manufacturing defects, damage in transit, or delivery errors. In the event of damage caused in transit, including dents or breakage, the CUSTOMER has 24 hours to report the incident by sending an email to [email protected]. In the case of manufacturing defects or delivery errors, no more than 14 days must have passed since receipt of the product, and the original packaging and accessories must be included. Prior to acceptance, it will be verified that the product is a manufacturing or packaging defect or anomaly and not due to improper or negligent use, handling, or storage. They must always be accompanied by the corresponding delivery note or invoice. In the case of returns due to a manufacturing or packaging defect, or in the case of an error in the order on the part of MILUKA, the CUSTOMER will be offered, if possible, the repair of the part or its replacement with an alternative at no additional cost and without the CUSTOMER being entitled to any type of compensation. The costs incurred in shipping the repaired or corrected order will be borne by MILUKA. In any case, the return will always be subject to prior examination by MILUKA of the condition of the returned product and verification that the requirements set forth in these terms of sale have been met. Once the return is received, and if applicable, we will refund the amount charged within a maximum period of 30 days and under the same terms used to make the payment. The product must be returned in the same condition in which it was delivered, preserving its original packaging. MILUKA reserves the right to reject returns reported or sent outside the established deadline, or products that are not in the same condition as when received. Returns will be processed by sending an email to [email protected] with a description of the reasons and reasons given for the return, as well as photographs that adequately demonstrate the damage or defect. All notifications between the parties will preferably be made via email. The CLIENT is responsible for confirming receipt of notifications and for informing MILUKA of any changes to their data. MILUKA is exonerated from any liability arising from this circumstance. In the event of any changes, the CUSTOMER must notify MILUKA by email or by phone at the address indicated on our website. The CUSTOMER acknowledges having read and accepted the legal conditions of use and the privacy policy of the website. This contract is of a commercial nature and shall be governed by and construed in accordance with Spanish law. The contracting process requires you to complete personal data forms for the purpose of processing and managing orders and, if you authorize it, to send you commercial information about our products and services. Payments are made prior to delivery of the product or provision of the service, so MILUKA will not provide the requested product until payment has been received. MILUKA reserves the right to temporarily or permanently cancel the services provided in the event of any incident related to payment collection.5. INVOICES
The CUSTOMER is responsible for confirming receipt of notifications and for informing us of any changes to their information. MILUKA is exonerated from any liability arising from this circumstance.6. WARRANTY

7.1. RIGHT OF WITHDRAWAL
IMPORTANT: In accordance with article 103, point c, of Royal Legislative Decree 1/2007, of November 16, on the Protection of Consumers and Users, the right of withdrawal will not apply to contracts relating to the supply of goods made according to the specifications of the consumer and user or clearly personalized.
The withdrawal period will expire 14 calendar days after the day on which the CUSTOMER or a third party indicated by the CUSTOMER, other than the carrier, acquired physical possession of the goods.
In the event of withdrawal by the CUSTOMER, we will refund all payments received, including delivery costs (with the exception of additional costs resulting from Your choice of a delivery method other than the least expensive standard delivery method we offer) without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.
The CUSTOMER shall bear the direct costs of returning the goods, and the cost of collection will be deducted from the refund, except in the case of defective quality or shipping error on our part.
We will process said refund using the same payment method used for the initial transaction (except in the case of cash on delivery), unless you have expressly agreed otherwise; in any case, you will not incur any costs as a result of the refund. We inform you that we may withhold reimbursement until we have received the goods, or until the CUSTOMER has provided proof of their return, whichever is met first.
The returned goods must be in perfect condition and not have been damaged, deformed, or show signs of wear, scratches, or stains. The CUSTOMER shall be responsible for any decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the goods.7.2 FOR DEFECTIVE OR DAMAGED PRODUCTS IN TRANSIT
8. EXECUTION OF THE CONTRACT AND MODIFICATIONS TO THE SERVICES
MILUKA reserves the right to modify the characteristics and conditions of its services in any way, always with the aim of improving them and benefiting the CUSTOMER.9. OBLIGATIONS OF THE PARTIES
The CUSTOMER undertakes to use the services made available in good faith, without violating any applicable laws or infringing the rights of third parties, as well as to pay for the selected product in the time and manner established in these terms of sale and to receive it at the place indicated for delivery.
MILUKA does not guarantee that the availability of the service covered by this contract will be continuous and uninterrupted due to circumstances arising from problems with the Internet network, computer failures, and other unforeseen circumstances. Therefore, the CLIENT agrees to accept these circumstances within reasonable limits and expressly waives any liability against MILUKA, whether contractual or extracontractual, for any errors, failures, or misuse of the contracted service.10. COMMUNICATIONS
In compliance with Article 21 of Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that our commercial communications and information regarding our website and the products offered therein will be sent by email to the email address you provide, always revocable. In the event of any discrepancy or dispute between the parties regarding the interpretation, content, or execution of the Contract that is not resolved by mutual agreement, the Parties shall submit to the competent courts in each case.
